Omnicare Sued Under FCA…Again

A False Claims Act suit has been filed against nursing home pharmacy Omnicare, just over two years after the company paid $98 million to settle a similar suit.  The latest complaint, filed by a former employee, alleges that the company inflated its reimbursement prices by dispensing drugs with different National Drug Codes than the actual drug dispensed.

The whistleblower stated that while working for the company he noticed suspicious practices, such as charging $1000 for a compound of two chemicals that had each cost $2 or regularly miscoding products, which he was allegedly told had been approved by the company’s associate director.  After the employee raised his concerns to his supervisors, he was fired.  The complaint alleges that the company defrauded the government of millions of dollars.
