Stuart F. Delery, the Assistant Attorney General for the DOJ’s Civil Division, addressed the ABA’s 10th National Institute on the Civil False Claims Act and Qui Tam Enforcement. Delery used his remarks to emphasize that “the False Claims Act works” because it is an effective tool to fight fraud, provides powerful incentives for companies to do business the right way, and safeguards billions of dollars of taxpayer money. He also highlighted the DOJ’s renewed emphasis on non-monetary remedial measures, which are designed to ensure compliance by companies and prevent misconduct from happening again. Delery noted that over $17 billion has been recovered under the FCA since 2009, with the government recording the largest annual recovery ever in fiscal year 2012–almost $5 billion–and the second-largest annual recovery of $3.8 billion last year.
