Lance Armstrong Settles Whistleblower Suit for $5,000,000; Whistleblower Floyd Landis Eligible for Portion of Reward

When Lance Armstrong repeatedly cheated to win the Tour de France he probably never expected the federal whistleblower law – the U.S. False Claims Act – to be a factor. Yet, his former teammate and whistleblower Floyd Landis exposed Armstrong’s illegal doping and used the False Claims Act to bring an action against Armstrong for cheating the U.S. Postal Service — which had sponsored Armstrong on condition that he would not use performance enhancing drugs.

The government announced today that it would settle the case for $5 million. Landis, as the False Claims Act whistleblower, is eligible for up to 25% of that amount. While the government did not recover the full amount that it claimed the Postal Service had been damaged, the case marks another new area where whistleblowers, using the False Claims Act, have made a difference.
