The Department of Justice (“DOJ”) announced today that settlements and judgments under the False Claims Act exceeded $2.2 billion in the fiscal year ending September 30, 2022. DOJ reported that over $1.7 billion of those recoveries related to matters that involved the health care industry, including cases relating to: (1) fraud and abuse in the Medicaid program; (2) the provision of unnecessary services and substandard care; and (3) the Medicare Advantage program.
DOJ also reported that, of the $2.2 billion in settlements and judgments recovered, over $1.9 billion arose from lawsuits filed under the qui tam provisions of the False Claims Act. During this period, the government paid out over $488 million to individuals who blew the whistle on fraud and filed these actions.
In total, recoveries under the False Claims Act since 1986 — when Congress substantially strengthened the civil False Claims Act — now total more than $72 billion.
