FCA Suit Against B of A Unsealed

A second whistleblower suit reportedly related to the $1 billion Bank of America settlement with the U.S. Attorney’s Office in Brooklyn was unsealed in federal court on Wednesday.  According to the complaint, Countrywide Financial, a Bank of America subsidiary, engaged in fraudulent activities in order to prevent customers from becoming eligible for Home Affordable Modification Program, a federal program that assists homeowners facing foreclosure.  The company allegedly pretended to lose homeowners’ files and failed to credit payments made by homeowners during trial modifications.

The complaint was filed by a former employee of Urban Lending Solutions, a company that worked with Bank of America in processing Home Affordable Modification Program (“HAMP”) claims.
