The Supreme Court denied certiorari to an appeal from the First Circuit’s decision in United States ex rel. Hutcheson v. Blackstone Medical Inc..  The Circuit Court’s decision held that a claim involving a violation of the Anti-Kickback Statute could result in False Claims Act liability, as such a violation could be material to the government’s payment decision.
