Florida Health Care Provider and Physician to Pay $12 Million False Claims Act Settlement

Dr. Todd J. Scarbrough and Melbourne Internal Medicine Associates P.A. (MIMA) will pay the United States $12 million to settle allegations that they violated the False Claims Act by submitting false claims to Medicare and the military’s health care program TRICARE.

Allegedly, the MIMA Cancer Center, led by Dr. Scarbrough, improperly inflated claims to Medicare and TRICARE through schemes designed to hide the fraudulent practices.  Specifically, the Center billed for unsupervised services, repeat and unnecessary services, services never performed, and billed for higher cost procedures than those actually performed.  The U.S. investigation also found that MIMA executives knew about many of these practices but failed to do anything to stop them. 

The lawsuit was filed by whistleblower Fred Fangman under the False Claims Act.  Mr. Fangman, former director of radiation oncology at MIMA Cancer Center, will receive $2.64 million out of the settlement.
