A whistleblower’s suit against the medical device manufacturer Medtronic alleging illegal kickbacks was allowed to go forward despite the fact that much of the information in that suit was based on public information. The judge in the case held that the information provided by the whistleblower “meaningfully adds” to the publicly disclosed information. Under the U.S. False Claims Act, this makes the whistleblower an “original source” of the information, and saves the suit from dismissal.
