Amendments to New York False Claims Act Posted

The New York Attorney General’s Office officially posted an updated copy of the New York False Claims Act (NYFCA) that reflects two recent amendments to the statute passed into law.

The amendments: (1) increased the civil penalties that defendants must pay when found liable under the NYFCA to match the penalties of the United States False Claims Act, and (2) require the New York Attorney General’s Medicaid Fraud Control Unit to file an annual report stating the amount of monies it recovers pursuant to the NYFCA each year.

The increase in penalties raises the minimum penalty a defendant must pay under the NYFCA to $10,957 per violation of the statute (up from $6,000), and the maximum penalty to $21,916 (up from $12,000). The penalties will continue to be adjusted each year to reflect changes in the inflation rate that impact the penalties of the United States False Claims Act.
