New York Legislature Strengthens Whistleblower Law

The New York State Legislature has approved a new law that would strengthen the New York False Claims Act (“NYFCA”) to penalize wealthy taxpayers and corporations that purposefully fail to file tax returns.  The companion bills that passed the Senate (S. 4730) and Assembly (A. 2543) would close a loophole in which individuals and corporations who simply fail to file a tax return – as opposed to filing a false tax return – are out of reach from enforcement under the law.  The proposed change to the NYFCA empowers individuals to blow the whistle on these tax evaders, and will result in the recovery of tax revenue by the State.  The bill is expected to be signed by New York’s Governor.
