In March 2004, U. S. District Judge Arthur D. Spatt appointed Getnick & Getnick LLP as the Monitor of NYRA pursuant to the terms of a December 2003 deferred prosecution agreement between NYRA and the United States Attorney’s Office for the Eastern District of New York. NYRA was charged with federal crimes, including one count of conspiracy to defraud the United States and three counts of aiding and abetting false tax filings. Getnick & Getnick LLP monitored NYRA’s daily activities and operations (i) to ensure that NYRA complied fully with the terms of the agreement and all relevant laws and regulations, (ii) to deter and report upon unethical or illegal conduct by NYRA, and (iii) where appropriate, to suggest structural reforms.
In carrying out the Court’s mandate, Getnick & Getnick LLP assembled a multi-disciplinary team of attorneys, forensic auditors and investigators and maintained an on-site presence at each of the three race tracks during its respective race meet. The firm monitored and reported on all aspects of NYRA’s business, from corporate governance and business operations to activities on the backstretch.
This monitorship officially terminated at the end of July 2005. Pursuant to Court Order, Getnick & Getnick LLP reported to and took direction from the New York State Comptroller’s Office and the U.S. Attorney’s Office for the Eastern District of New York.
